CHECK-IN TIME IS 4 P.M. OR AFTER. CHECK OUT TIME is 10 A.M. A $100 fee will be charged if property is not vacated by 10 A.M. unless prior arrangements have been made with Harborview Rentals (“Agent”).
KEYS. Please pick up your keys at Harborview Rentals, 291 S. Collier Blvd, Suite 103, Marco Island, FL 34145. If arriving on a Sunday or after business hours, your check-in package will be placed in our lockbox just outside the Harborview office. If keyless access instructions will be emailed prior to arrival.
OCCUPANCY. This property is rented as a private dwelling, consisting of the number of people stated above and is not to be used for any other purpose or occupied by any other person without first obtaining the Agent’s written consent. Please refer to the house rules for your unit regarding the maximum number of people allowed in the unit at any one time, but at no time are you permitted to have more than twenty(20) people at any one time.
UTILITIES. If you occupy a house, you are responsible for electric bills over $200/wk, $275/2 wks, $325/3 wks or $400 per month, whichever is applicable. If you occupy a house, you are responsible for all natural gas charges for gas heated pools over $200/wk, $275/2 wks, $325/3 wks or $400 per month, whichever is applicable.
CANCELLATION. You will receive 80% of any amount recovered if Agent is successful in re-booking the cancelled time. You will forfeit all monies paid if we are unable to re-rent this unit. Notwithstanding anything to the contrary if an act of God or the State of Florida issues a government order that prevents you from occupying the rental unit for the period listed above, then your payments shall be applied to a new period within 365 days of your expected departure date which is mutually agreed upon by Renter and Manager. If you are prevented from occupancy as set forth in this paragraph and agreement for new dates is not executed by expected arrival date, you will be refunded in full. Any Covid-19 related illness is not a reason for postponement or refund.
PAYMENT. Payments will be separated into 2 installments. Fifty percent(50%) will be due 3 days after booking. Remaining fifty percent(50%) will be due 150 days prior to arrival. If booking happens within 150 days, only 1 payment will be due, 3 days after booking. If at any point in time a governing body should increase the tax rate, you will be responsible for paying any increase prior to arrival. If booking takes place within 2 weeks prior to arrival, payment by credit card will be required. Payments may be made by Visa, MasterCard, or Discover. A 3% service charge will be added if you make a payment by Visa or MasterCard. We do allow for guests to overnight a check. If check is not received by payment due date reservation will be cancelled.
PETS. No pets are permitted in rental units unless previously agreed upon with owner. Support animals or pets may be prohibited by condominium and homeowner associations. Renter should confirm animal/pet policy for this property before renting as Renter assumes all risk of animal/pet exclusions and any pet or animal exclusion policy will not allow termination of this agreement by Renter.
LOST KEYS. There will be a $100 charge for each lost unit key, FOB and garage card, $200 charge for lost magnetic keys and $100 charge for any parking pass, which cannot be reissued. There is a $100 charge for lost garage door openers.
SUBLEASES. Subleases are not permitted.
AGE REQUIREMENT. This unit must be occupied by at least one person over the age of 25 throughout the entire rental period.
ALL UNITS ARE CONSIDERED NON-SMOKING PROPERTIES UNLESS OTHER ARRANGEMENTS HAVE BEEN MADE.
MARKET COOPERATION. From time to time, owners decide to sell their units. If the owner should decide to place this unit on the market, you agree to co-operate with the listing office in permitting the unit to be shown if you are given reasonable notice. In the event the owner of the unit we have confirmed elects to remove it from our rental program, we will arrange comparable accommodations for your visit or you will receive a full refund.
INVENTORY. All units are fully equipped with towels, linens, cooking and eating utensils, and beach gear. TOILETRIES, PAPER GOODS, CLEANING SUPPLIES, AND CONDIMENTS ARE NOT PROVIDED. Initial paper towel and toilet paper rolls, garbage bag(s) will be provided.
RADON GAS. Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county health department.
INDEMNIFICATION. Unit Owner, as well as Harborview Rentals and its directors, officers, and employees, and stockholders, (collectively, “Indemnified Parties”) shall not be liable for any damage or injury of or to the Renter, Renter’s family, guests, invitees, Agents or employees or to any person entering the Premises or the building of which the Premises are a part or to goods or equipment, or in the structure or equipment of the structure of which the Premises are a part (including kayaks, paddleboards, watercraft, chairs and umbrellas, and/or bicycles), and Renter hereby agrees to indemnify, defend and hold Owner and Agent harmless from any and all claims or assertions of every kind and nature.
WATERCRAFT. Your rental may include the use of a watercraft. Watercraft must be secured on the dock at all times as high winds and quick moving storms may occur with little notice. In the event that a watercraft is lost due to Renters negligence, Renter will be charged for the replacement of the watercraft, including the cost to retain a replacement quickly for any new incoming parties. Trailer parking is prohibited by the City of Marco Island. Guests are responsible for storing trailer if needed.
REPAIRS. If any damage, beyond normal wear and tear, is caused by Renter or his guest, Renter agrees to pay the cost of repair by the end of this agreement. Specifically, your rental may include a screen enclosure. In the event that the screen is damaged in any way, including rips, tears, stains, or other such damage, you will be held financially responsible for the replacement or repair of the screen to return to its original condition.
DAMAGE PROTECTION. Damage protection fee covers guests up to the base rate amount, maximum $2,000, whichever amount is less for any incidental damage that might occur while occupying. Guest should report to Harborview office of any damages that might occur while staying.
RENTER’S HOLD-OVER. Renter shall remove all Renter’s property and deliver possession of Premises in a clean condition and good order and repair upon termination or expiration of this agreement. In the event that Renter fails to vacate the Premises after termination, non-renewal, or expiration of this rental agreement, this becomes a tenancy at will. The Renter shall pay an amount equal to two times the existing rental rate, prorated by the day held over and beyond the termination or expiration of this agreement in addition to the other damages provided for under this agreement. Additionally, if the hold-over interferes with a subsequent rental agreement, Renter will be liable for the loss of revenue that cannot be recovered after moving out.
RULES & REGULATIONS. By signing this confirmation, you are agreeing to comply with all of the condominium or house rules and regulations and to refrain from becoming a nuisance while occupying the leased premises. Renter shall comply with any and all laws, ordinances, rules and orders of any and all governmental, quasi-governmental, or condominium association authorities affecting the cleanliness, use, occupancy and preservation of the Premises. Guest is responsible for all fines and fees that occur during their stay.
QUIET HOURS. Quiet hours are from 9:00pm to 9:00am.
GUEST AGREES TO PAY BUILDING REGISTRATION FEE, IF APPLICABLE.
